Attention to Detail
Negotiating a short sale is a very complex and time consuming process. Before we even approach the bank with the offer, we put together a short sale package. The package includes dozens of documents, including past tax returns, paycheck stubs, hardship forms, and property valuations. We will not submit it to the bank until it is complete.
As lawyers, we also prepare the proposed HUD-1 statement which lists all costs to the lender, including the real estate commission, attorney fee, transfer tax, unpaid taxes, unpaid water and sewer bills. We must make sure we do not omit any possible costs because they are paid by the lender and they must be disclosed right up front, before we get lender approval. This is why it is preferable to have an attorney do the work and not a realtor or "negotiating company" who popped up over the last 6-12 months to attempt to learn how to handle a short sale for some extra income and has no clue as to what they are doing.
